This Consent, Waiver of Liability, and Indemnification ("Waiver") is read and signed by the individual participating in the product testing (the "Participant" or “I”). In consideration for being permitted by GOODAI GLOBAL INC. (the "Company") to participate in the ‘Beauty of Joseon’ product testing event (the "Event"), I hereby acknowledge, understand, and agree to the following: 

1. Voluntary Participation. I understand and confirm that my participation in the Event is completely voluntary. The Event involves the application of cosmetic products ("Products") to the skin for the Participant's complimentary trial and testing purposes. 

2. Assumption of Risks. I understand that the use of cosmetic products carries inherent risks. I acknowledge that potential risks associated with the use of the Products may include, but are not limited to: skin irritation, allergic reactions (such as redness, itching, swelling, or rash), breakouts, or eye irritation. I understand the Product's warnings and directions for proper use, which include, without limitation, that: (a) the Products are for external use only; (b) the Products must be kept out of the eyes and rinsed with water if contact occurs; (c) use of the Products should be discontinued and medical advice should be sought if a rash occurs; and (d) the Products should be kept out of reach of children, and, if swallowed, medical help should be sought or a Poison Control Center contacted immediately, and which further include, but are not limited to, that, with respect to sunscreen Products, they should be applied before sun exposure, reapplied frequently, and used in conjunction with other sun protection measures (e.g., limiting sun time, wearing protective clothing). I assume all risks associated with the use of the Products, including those described above and any other risks, whether known or unknown, foreseeable or unforeseeable, and voluntarily choose to participate in the Event with full understanding of such risks. 

3. Participant's Health Representations. I represent and warrant that I have no medical or physical conditions that would preclude me from safely participating in the Event. I have disclosed to the Company staff any and all known allergies, skin sensitivities, or pre-existing skin conditions. The area of my skin to be used for testing is free from any cuts, wounds, rashes, sunburn, or any other pre-existing skin conditions that could be exacerbated by the product.  

4. Waiver and Release of Liability. To the fullest extent permitted by the law, I, on behalf of myself, my heirs, executors, administrators, and assigns, legal guardian, conservator, legal representative, hereby waive, release, and forever discharge the Company from any and all claims, demands, liabilities, rights, actions, causes of action, and suits of any kind or nature whatsoever, which I may now have or may hereafter have, arising out of or in any way connected with my participation in the Event and use of the Products. This includes, but is not limited to, any injuries, damage, or losses, whether to person or property, caused in whole or in part by the negligence or fault of the Company. 

5. Indemnification. I agree to indemnify, defend, and hold harmless the Company from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from my participation in the Event, including any claims brought by or on behalf of myself, or any third party, related to my use of the Products or presence at the Event. 

6. Governing Law and Jurisdiction. I agree that this Waiver, and any dispute, claim or controversy arising out of or in connection with this Waiver, the Event, my participation in the Event, or the use of any products in relation thereto (including, without limitation, any claim in contract, tort or otherwise), shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles. I irrevocably consent to the exclusive jurisdiction and venue of the courts located in Seoul, Republic of Korea, for the resolution of any such dispute. 

7. Severability. If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible, and the invalid or unenforceable provision shall be deemed modified so that it is valid and enforceable to the maximum extent permitted by law. 

 

I HAVE READ THIS DOCUMENT CAREFULLY AND I FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A WAIVER AND RELEASE OF LIABILITY AND A LEGALLY BINDING DOCUMENT, AND I SIGN IT OF MY OWN FREE WILL. 

 

By signing below, I confirm that I have the legal capacity and authority to enter into this Waiver and have read, understood, and voluntarily agreed to all terms and conditions of this Waiver.
